Focus on the Family to Congress: 'ENDA is a Litigation Minefield'

As you should know by now, we are proudly associated with Focus on the Family, including Focus.  Yesterday, my friend Tom Minnery, Senior VP for Government and Public Policy at Focus on the Family sent a letter to the United States House of Representatives, urging the congressmen and women to carefully state their opposition to the Employment Non-Discrimination Act, commonly called “ENDA.”

Focus on the Family has sent a letter to Congress asking it to oppose the Employment Non-Discrimination Act (ENDA).  The legislation would grant special protections to people based on sexual orientation.

Tom Minnery, vice president of government and public policy at Focus on the Family, said the measure would wreak havoc.

“This is going to be a minefield of new lawsuits,” he said, “filed by people who are suddenly feeling that they are discriminated against by any religious object in any workplace.”

The letter contains examples of Christian businesses and employees unduly harmed by ENDA-type policies.  Ashley Horne, federal policy analyst for Focus on the Family Action, said ENDA’s passage would threaten religious freedoms.

“Gay rights activists have wanted this bill for a long time,” she said, “to keep religious employers from being able to hire and fire based on their moral convictions.”

The House is expected to take action on ENDA before the December recess.  Horne said the letter makes clear Focus’ opposition to its passage.

“We want representatives to vote ‘no’ on this bill,” she said.  “It is a direct attack on religious liberty.”

We applaud Focus on the Family’s valiant stand for religious liberty and echo their call for Congress to reject the creation of special rights for those with same-sex attractions.  We echo the concerns regarding the impact ENDA would have, not simply upon religious liberty, but upon small business in West Virginia.  Minnery’s letter reads in part:

ENDA will also increase compliance costs for businesses – costs that small business can ill-afford, particularly during this economic downturn.  Employers will be forced to consult legal counsel in order to upgrade their employment manuals, policies and procedures and train human resources staff to understand and comply with these confusing new employment discrimination categories.  While many homosexuals have come to the conclusion that they were “born gay,” there exists a significatn minority of homosexuals and bisexuals who recognize that sexual orientation is quite fluid.  How can a business be expected to avoid discriminating against categories of individuals that are potentially ever-changing and based on subjective self-identification?
